The Montevallo City Council tabled action Monday night to rezone 15 acres of property owned by Kencar Development (Kenneth Carter) from A-O (Agriculture-Open District) to D-2 (Development District).

The property is located on Highway 119 near Highway 24 north of the Colonial Oaks Development.

The suggestion to table the action, which did not require vote, followed a public hearing during which objections were voiced by the University of Montevallo Foundation and Carr & Associates Engineers Inc.

An A-O District serves to protect areas that are predominantly rural or agricultural in character. A D-2 Development District provides for moderate density residential development and for necessary commercial and institutional uses.

The Montevallo Foundation is owner of the Ebenezer Wetlands contiguous to the proposed Quail Run development.

In a letter to the city, Executive Director David R. Aiken wrote, &uot;Unfortunately, we have not been given the opportunity to either consider the proposed development, nor to suggest remediation should an adverse impact be anticipated. Accordingly, we ask that consideration of the rezoning be deferred until such a review occurs and a neutral impact on Ebenezer can be demonstrated.&uot;

Chris D. Pappas of Carr & Associated Engineers Inc. also contended in a letter to the city that a contingency of the Planning and Zoning Board was that developer and his engineer schedule a meeting with Carr & Associates and a representative of the University of Montevallo and that such a meeting had not occurred.

Pappas also listed six items of concern: horizontal curves appear to be minimum or less than minimum; access to Highway 119 is slightly offset from Eddings Lane; side yard setback is listed as five feet and is undesirable; approval from a pipeline owner must be obtained as a petroleum pipeline crosses the site; the location of a pump station should be considered; and the University of Montevallo should be contacted to provide them the opportunity to offer their comments and environmental concerns.

Bob Doyle, chairman of the Montevallo Planning and Zoning Board said no deadline was imposed on the developer but had the meeting between engieers taken place that issue could have been resolved earlier.

According to Mayor Sharon Anderson the Planning and Zoning Board recommended the zoning change be granted on a 4-2 vote pending a meeting of the city’s engineer and the engineer for the developer with a suggestion that the University of Montevallo also be consulted.

Carter said comments about engineers not getting together were &uot;way off base.&uot;

Carter also said he would not spend $35,000 to $40,000 on engineering first in hopes to get zoning.

Following a public hearing on the matter, Councilmember Becky Cox-Rodgers suggested that the matter be tabled with the developer’s engineer to the contact the city’s engineer and provide courtesy involvement to the University of Montevallo.

Mayor Anderson appointed a sign ordinance committee to meet with Bob House, a planner from Hoover, at its first meeting today at 4 p.m.

The committee includes Bob Doyle, Catherine Legg, Scott Reneau, Scott Lovelady, Susan Fulmer and B.J. Jackson.

The council approved an ABC (Alabama Beverage Control) application for Bryant Turner for the Alabama Coach Company location.

Turner said he plans to open and &uot;Outback&uot; style restaurant that will make use of a lot of the old equipment and atmosphere of the coach company. He said he plans to open by August.

Cox-Rodgers recommended that the city look into writing an ordinance to set all

street parking time limits at two hours and to raise parking tickets to $30.

The council received the nomination of Eddie Williams to replace Claud Elledge on the Industrial Development Board.

The council suspended the rules and approved Kistren Bridges to replace Hollie Cost on the Arbor and Beautification Commission.

The council approved an agreement with the Water Works Board regarding waterline extentions from Highway 22 to 24 with developers to extend the line to Highway 119 pending all parties sign the agreement.

Anderson announced the city has been awarded a Shelby County Parks & Recreation Grant for $11,875.50 to be matched by $30,000 from the city to improve the park across from Montevallo Middle School.

The council also approved the creation of an operations manager/city engineer position
