A Pelham man arrested in Georgia on charges of felony murder, aggravated assault and aggravated battery has been indicted, the Douglas County, Ga., District Attorney’s Office confirmed on Aug. 8.

Dewey Calhoun Green, 23, was indicted on one count of malice murder, three counts of felony murder and three counts of aggravated assault.

According to the criminal code of Georgia, “express malice is that deliberate intention unlawfully to take the life of another human being which is manifested by external circumstances capable of proof. Malice shall be implied where no considerable provocation appears and where all the circumstances of the killing show an abandoned and malignant heart.”

Each count of felony murder and malice murder carries a life sentence, and is punishable by death. Each count of aggravated assault carries a sentence of between one and 20 years in prison, according to the criminal code of Georgia.

If found guilty of all charges against him, Green could face the death penalty.

Green was arrested in Douglasville, Ga., on June 25 after allegedly causing an accident resulting in the death of Douglasville, Ga., resident Janice Pitts, 53.

According to Douglasville Police Chief Chris Womack, Green exited Interstate 20 and rear-ended Pitts’ car. He allegedly repeatedly “rammed” the vehicle, pushing it “about 38 feet forward.”

When Pitts got out to survey the damage to her vehicle, Green allegedly “pinned” her between “the passenger side of his truck and the driver’s side of her vehicle,” he then allegedly “put his truck in reverse and ran over her backwards,” killing her. Green allegedly attempted to flee the scene of the crime, but ran his truck “up on an embankment in front of Walgreens,” whereupon onlookers apprehended and held him until law enforcement arrived, Womack explained in a phone interview shortly after the incident.

Green was placed in the Douglas County, Ga., Jail and held without bond. He was originally scheduled for a preliminary hearing on Aug. 7, however that hearing was cancelled after the indictment was handed down, the Douglas County, Ga., District Attorney’s Office confirmed.

Green is currently being held in the Douglas County, Ga., Jail without bond.
