Woman gets probation on felony marijuana charge

COLUMBIANA – A 29-year-old Hoover woman will spend the next two years on probation after she pleaded guilty to a felony first-degree possession of marijuana charge, which was reduced from trafficking marijuana through a plea deal.

Shelby County Circuit Court Judge Dan Reeves sentenced Mallory Osborn Brooke, who lists an address in the 3400 block of Flinshire Drive in Hoover, to three years in prison, but suspended the sentence to two years on probation.

While on probation, Brooke must pass random drug and alcohol tests and must successfully complete a substance abuse treatment program. She also must surrender her driver’s license for suspension.

Osborn originally was charged with trafficking marijuana – a Class A felony punishable by up to life in prison – when she was arrested by the Shelby County Drug Enforcement Task Force on Jan. 10, 2012. According to her indictment, Osborn had 2.2 pounds of marijuana in her possession in the 200 block of Lane Park Circle in Maylene on Dec. 8, 2011.

She also was charged with having cocaine and drug paraphernalia in her possession on Dec. 8, 2011.
