COLUMBIANA – The jury trial for a lawsuit brought by Shelby County against Treetop Family Adventure in Chelsea has been rescheduled again for Nov. 2 at 9 a.m.

The trial was scheduled for June 15. A motion to continue filed in Shelby County Circuit Court by Jesse Evans, Treetop’s attorney in the case, was granted June 10 by Circuit Judge Hewitt L. Conwill, according to court documents.

Previously, the case was set to go to trial in December 2014 and was changed to Feb. 19 and Treetop Family Adventure LLC and Jones Commercial Properties LLC, defendants in the case, filed a motion Feb. 16 requesting for the court to continue the trial at least 60 days “to allow the parties additional time to complete discovery,” according to court documents.

Shelby County filed a lawsuit in October 2013 against Treetop Family Adventure LLC, an amusement park, and Jones Commercial Properties LLC, claiming the park improperly connected a driveway to Dunnavant Valley Road because it did not first obtain a permit for the road from the Shelby County Commission.

The lawsuit seeks to block access to a driveway leading from Dunnavant Valley Road to the facility.
