I would like to speak to the people of Shelby County, and especially private property owners.

Shelby County citizens should take a close look at what the Shelby County planning commission is doing. Your right to own property and do with it as you choose has been stripped away from you.

In 1982, the Legislature of Alabama passed Act 82-693, which set up the Shelby County Planning Comission. The act states that the voters in each beat in the county have to hold an election to vote to give the planning commission authority in the beat. While that has not happened in most beats, the commission today is enforcing its authority county-wide.

Here’s how. This is the exact wording of Section 3, Jurisdiction of Commission:

“The jurisdiction of the commission shall extend to all areas of the county outside the boundaries of municipal corporations, unless a municipality expressly requests by resolution to have the jurisdiction of the planning commission extend into its corporate area.”

With these few words, the county commission has taken control of all land in Shelby County. There is no limit on what they can do or require you to do, and you never got a chance to vote on it.
