Pelham holding special meeting to discuss ABC license

The Pelham City Council has set a special meeting Oct. 5 to discuss granting a liquor license to McDuff’s Pub and Grill on Canyon Park Drive.

The meeting will begin at 5:30 p.m. at Pelham City Hall off U.S. 31.

The announcement came one day after the Pelham City Council voted 3-2 to table a motion to grant the license to the establishment, which is owned by Michael Overton.

During the council’s Oct. 3 meeting, Pelham Police Chief Tommy Thomas told council members Overton did not properly fill out the ABC application when he applied for the license. Councilman Steve Powell also said Overton did not furnish a required certificate of occupancy in the application.

Overton indicated on the application he had been arrested in the past, but did not properly indicate in the application if he had been convicted of the charges, Thomas said.

However, Councilman Bill Meadows said Overton attached a list and disposition of the charges on a separate sheet attached to the application, and said Overton is essentially “out of business” until the council votes on the matter.

Thomas said he would have to check with the Alcohol Beverage Control board to see if he could accept the attached sheet before making a recommendation to the council.

“It’s not appropriate for me to go in and enter date on (ABC’s) application. That’s their application, not mine,” Thomas said.

Thomas said he would attempt to contact the courts in which Overton was charged in the past to learn the disposition of the charges brought against Overton.

“I would think the council would like to know the disposition of those charges before making a decision,” Thomas said.
